Centre notifies new laws allowing anyone to buy land in J&K, Ladakh
The home ministry has removed the ‘permanent resident’ criteria.
The Ministry of Home Affairs on Tuesday notified new land laws for the Union Territories of Jammu and Kashmir, and Ladakh. This makes it possible for any Indian citizen to buy land in the region, sparking fears among locals as it was earlier meant only for permanent residents under Article 370.
The Narendra Modi government’s evacuation of uncommon status of Jammu and Kashmir in August 2019 opened the entryway for untouchables to purchase land and property, land government positions and go to organizations of advanced education. The law had engaged the legislature of the previous state to characterize “perpetual occupants” of Jammu and Kashmir and save certain rights for them.
In its request, the home service said the new laws will be known as the Union Territory of Jammu and Kashmir Reorganization (Adaptation of Central Laws) Third Order, 2020. It included that it will happen right away.
The Center said the “lasting occupant of the state” provision has been precluded now. Under this, 12 state laws have been canceled and 26 others have been adjusted with changes or substitutes, as indicated by ANI. Those totally revoked incorporate the Jammu and Kashmir Alienation of Land Act, 1995, the Jammu and Kashmir Big Landed Estates Abolition Act, the Jammu and Kashmir Common Lands (Regulation) Act, 1956, and the Jammu and Kashmir Consolidation of Holdings Act, 1962.
The notice expressed that the legislature may, on the composed solicitation of an Army official not underneath the position of Corp Commander, announce a zone “key” inside a neighborhood. This must be for the direct operational and preparing necessities of the Armed powers, which might be barred from the activity of this Act and rules and regulations made there under in the way and to the degree.
Previous Jammu and Kashmir Chief Minister Omar Abdullah condemned the revisions. “Unsuitable corrections to the land proprietorship laws of Jammu and Kashmir,” he tweeted. “Indeed, even the posturing of residence has been discarded when buying non-agrarian land and move of rural land has been made simpler. J&K is currently available to be purchased and the more unfortunate little land holding proprietors will endure.”
