SC issues notice to UP govt on plea against arrest of Kerala journalist on way to Hathras
Journalist Siddique Kappan was arrested by Mathura Police while on his way to cover the Hathras gang-rape incident. He has been charged under UAPA for his alleged links with banned outfit Popular Front of India.
The Supreme Court on Monday issued notice to Uttar Pradesh government and the state police seeking their response on a petition filed by Kerala Union of Working Journalists, challenging the detention of Siddique Kappan. The Kerala journalist was arrested by Mathura Police last month while he was on his way to cover the Hathras gang-rape incident.
A three-judge seat headed by Chief Justice of India (CJI) SA Bobde posted the issue for hearing on Friday.
Senior promoter Kapil Sibal, who showed up for the Union, looked for break bail for the columnist as he has been in prison since October 4.
The seat said that it would initially wish to hear the state and showed that it might guide the issue to be shipped off Allahabad high court.
“We are attempting to debilitate Article 32 petitions (intensity of Supreme Court to give help to infringement of major rights). There is a spate of Article 32 petitions,” the seat, additionally involving Justices AS Bopanna and V Ramasubramanian said.
Sibal brought up that this was the situation of the writer under confinement and comparative petitions have been engaged before.
The seat added, “We are not remarking on the benefits of the case. We know about comparative requests previously and the immense forces that this Court has under Article 32. We need to debilitate this pattern.”
Kappan is charged under the Unlawful Activities (Prevention) Act (UAPA) for his supposed connections with restricted outfit Popular Front of India (PFI).
