Supreme Court Seeks Centre’s Reply On Plea For Uniform Grounds Of Maintenance, Alimony For All
The plea seeks a direction to the government to take appropriate steps to remove the prevailing anomalies in the grounds of maintenance and alimony and make them uniform for all citizens without discrimination on the basis of religion, race, cast, sex or place of birth.
The Supreme Court today sought the Centre’s response on a plea seeking uniform “gender and religion neutral” grounds for all citizens in awarding maintenance and alimony in matrimonial disputes.
A seat headed by Chief Justice SA Bobde gave notification to the Union services of Home Affairs, Law and Justice, and the Women and Child Development on the supplication recorded by BJP pioneer and attorney Ashwini Upadhyay.
The seat, likewise containing Justices AS Bopanna and V Ramasubramanian, heard senior promoter Meenakshi Arora for Ashwini Upadhyay and stated, “We are giving notification with incredible alert.”
The request looks for a heading to the public authority to find a way to eliminate the overall irregularities in the grounds of upkeep and provision and make them uniform for all residents without segregation based on religion, race, caste, sex, or spot of birth.
The appeal, documented through supporter Ashwani Kumar Dubey, said in spite of the persuasive arrangements in the Constitution, the Central government has completely neglected to give even impartial, religion-nonpartisan uniform grounds of upkeep and provision for all residents.
